Overview
Früiio respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to valid claims of copyright infringement made to our designated copyright agent.
If you believe content on Früiio infringes your copyright, you can submit a takedown notice using the process below. If your content was removed in error, you can file a counter-notice to have it restored.
Submitting a false or misleading DMCA notice is a federal offense and may expose you to civil liability. Please only file a notice if you have a good-faith belief that your copyright has been infringed.
What DMCA Covers
The DMCA process applies to copyright infringement only — for example, someone posting your original photos, artwork, written content, or music without your permission.
The DMCA process does not cover:
- Trademark disputes — contact us at hello@fruiio.com separately
- Content you find offensive or disrespectful — use our in-app reporting tools instead
- Privacy violations or personal information requests — see our Privacy Policy
- Defamation or other non-copyright legal claims
How to File a Takedown
To submit a valid DMCA takedown notice, send an email to our designated agent at dmca@fruiio.com with the subject line "DMCA Takedown Notice".
We aim to process valid takedown notices within 5 business days. Incomplete notices may be rejected and will require resubmission.
Once we receive a valid notice, we will:
- Remove or disable access to the allegedly infringing content
- Notify the user who posted the content that it has been removed
- Inform that user of their right to file a counter-notice
Required Information
Your takedown notice must include all of the following. Notices missing any of these elements cannot be acted upon.
- Your identity: Your full legal name, mailing address, phone number, and email address.
- The copyrighted work: A description of the original work you claim has been infringed. If multiple works are covered, a representative list is acceptable.
- The infringing content: The specific URL(s) on Früiio where the infringing content appears. "It's somewhere on your platform" is not sufficient — we need exact links.
- Good-faith statement: A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.
- Signature: Your physical or electronic signature.
Counter-Notices
If your content was removed as a result of a DMCA takedown and you believe the removal was a mistake or the result of misidentification, you may file a counter-notice.
Send your counter-notice to dmca@fruiio.com with the subject line "DMCA Counter-Notice" and include:
- Your identity: Your full legal name, mailing address, phone number, and email address.
- The removed content: A description of the content that was removed and the URL where it previously appeared.
- Good-faith statement: A statement under penalty of perjury that you have a good-faith belief the content was removed as a result of a mistake or misidentification.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located, or if outside the US, any judicial district in which Früiio may be found.
- Signature: Your physical or electronic signature.
After receiving a valid counter-notice, we will forward it to the original claimant. If the claimant does not file a court action within 10–14 business days, we will restore the removed content.
Repeat Infringers
Früiio has a policy of terminating accounts of users who are found to be repeat infringers of intellectual property rights. We track valid takedown notices and will act on patterns of repeated violation, up to and including permanent account suspension.
This policy is applied in our reasonable discretion and consistent with DMCA safe harbor requirements under 17 U.S.C. § 512.
False Claims
Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing — or that material was removed by mistake — may be subject to civil liability, including costs and attorneys' fees.
We reserve the right to seek damages from parties who submit bad-faith or fraudulent DMCA notices.
